WhatsApp informs the Delhi High Court that its new privacy policy is on hold until the Data Protection Bill is released.

WhatsApp notified the Delhi High Court that its disputed privacy policy had been “temporarily” suspended. Senior attorney Harish Salve, appearing on WhatsApp, stated that the new privacy policy would not be implemented until the Data Protection Bill is released.

According to Salve, WhatsApp has responded to the Ministry of Electronics and Information Technology’s warning by stating that the social media giant “would not limit functioning for some time and will continue to provide users the updates.”

Salve was cited by Bar and Bench as saying, “The Centre believes the WhatsApp Privacy Policy violates the I-T Rules 2011.”

We will stick to this strategy until the Data Protection Bill takes effect. We deliberately decided to postpone the upgrade till then.”

WhatsApp presented the points at a hearing in which the instant messaging platform and Facebook were contesting a Competition Commission of India (CCI) investigation into the new privacy policy.

During the hearing, Salve argued that the CCI’s investigation was pointless and that it couldn’t say anything until the Parliament permitted him to disclose the data.

“I’ve promised myself that I won’t do anything until Parliamentary legislation is passed. I shall have a different policy for India if Parliament permits it. If it doesn’t, I’ll call you. “Salve was cited by Bar and Bench as stating.

The Delhi High Court had previously declined to stay a letter from the CCI seeking data regarding WhatsApp’s revised privacy policy.

The court had stated, “We would only encourage the DG, CCI to keep in mind that a Division Bench of this court is now considering the investigation against the appellant.”

On April 22, a single bench of the Delhi High Court dismissed Facebook and WhatsApp’s appeals against a CCI decision that the messaging service is investigated.
